ARTICLE 2 - SUBJECT:
The subject of this agreement is to determine the rights and obligations of the parties in accordance with the provisions of the Law on the Protection of Consumers No. 4077 and the Regulation on the Principles and Procedures for Distance Contracts, regarding the sale and delivery of the product specified below, which the BUYER ordered electronically from the www.nefelistore.com website owned by the SELLER, with the qualities and sales price specified.

ARTICLE 4 - GENERAL PROVISIONS:
4.1- The BUYER declares that they have read and become knowledgeable about the basic characteristics of the contract product, the sales price, payment method, and preliminary information regarding delivery on the www.nefelistore.com website and has given the necessary confirmation electronically.
4.2- The contract product shall be delivered to the BUYER or the person/entity at the indicated address within the period specified in the preliminary information on the website, depending on the distance of the BUYER's place of residence, provided that it does not exceed the legal 3-day period.
4.3- If the contract product is to be delivered to a person/entity other than the BUYER, the SELLER shall not be held responsible for the refusal of acceptance by the designated person/entity.
4.4- The SELLER is responsible for delivering the contract product in sound, complete, compliant with the specified qualities in the order, along with any warranty documents and user manuals if available.
4.5- Delivery of the contract product is conditional upon the signed copy of this agreement being delivered to the SELLER and the payment being made in the payment method chosen by the BUYER. In case the product price is not paid for any reason or is cancelled in the bank records, the SELLER is deemed to have been relieved of the obligation to deliver the product.
4.6- In the event of unauthorized use of the BUYER's credit card by unauthorized persons, not due to the BUYER's fault, resulting in the bank or financial institution not paying the product price to the SELLER, provided that the product has been delivered to the BUYER, the product must be returned to the SELLER within 3 days. In this case, the shipping costs belong to the BUYER.
4.7- If the SELLER is unable to deliver the contract product within the agreed time due to force majeure or extraordinary circumstances such as adverse weather conditions or interruption of transportation, the SELLER is obliged to inform the BUYER. In this case, the BUYER may cancel the order, request a replacement with a similar product if available, and/or postpone the delivery time until the obstructive situation is resolved. If the BUYER cancels the order, the amount paid will be refunded in cash within 10 days.
4.8- Defective or faulty products sold with a warranty document can be sent to the SELLER for necessary repairs, and in this case, the shipping costs will be covered by the SELLER.
ARTICLE 5 - RIGHT OF WITHDRAWAL:
The BUYER has the right of withdrawal within 7 days from the delivery of the contract product to themselves or the person/entity at the indicated address. To exercise the right of withdrawal, it is required to notify the SELLER by fax, email, or telephone within this period and the product must not have been used within the framework of Article 6. In case of exercising this right, it is mandatory to return the original invoice and a cargo delivery receipt indicating that the product delivered to the third party or the BUYER has been returned to the SELLER. The product price will be refunded to the BUYER within 7 days following the arrival of these documents. If the original invoice is not sent, VAT and other legal obligations cannot be refunded. The shipping cost of the product returned due to the right of withdrawal will be covered by the SELLER.
ARTICLE 6 - PRODUCTS THAT CANNOT BE RETURNED WITHIN THE RIGHT OF WITHDRAWAL:
Products that cannot be returned by their nature, single-use products, copyable software and programs, fast-aging or expired products are not subject to the right of withdrawal. For the following products, the right of withdrawal is subject to the condition that the product packaging is unopened, undamaged, and the product is unused:
- Portable Computers (No returns will be accepted after the original operating system is installed.)
- All kinds of software and programs
- DVDs, VCDs, CDs, and tapes
- Computer and stationery supplies (toner, cartridge, ribbon, etc.)
- All kinds of cosmetic products
- Phone credit orders
ARTICLE 7 - COMPETENT COURT:
For the implementation of this agreement, Consumer Arbitration Committees up to the value declared by the Ministry of Industry and Commerce or Consumer Courts at the place of residence of the BUYER or SELLER are authorized.
Upon completion of the order, the BUYER is deemed to have accepted all the terms and conditions of this agreement.
